1. Acceptance of Terms
By accessing, registering for, or using AutomatikPro™, including its website, software, tools, free trials, subscriptions, and related services (collectively, the “Service”), you agree to be legally bound by these Terms & Conditions (“Terms”).
If you do not agree to these Terms, you must not access or use the Service.
2. About AutomatikPro™
AutomatikPro™ is an all-in-one CRM, marketing automation, and business management platform that enables users to manage leads, communications, websites, funnels, workflows, appointments, reputation management, and customer engagement from a single system.
3. Eligibility
There are no specific age restrictions beyond the legal age of majority in the user’s jurisdiction.
By using AutomatikPro™, you confirm that:
- You are legally capable of entering into a binding agreement
- You have the authority to act on behalf of a business if using the Service commercially
AutomatikPro™ does not restrict user industries unless required by law or by third-party service providers.
4. Free Trial
AutomatikPro™ may offer a 14-day free trial to new users.
- No platform subscription fees are charged during the free trial
- You may cancel anytime during the trial
- Once the free trial ends and payment begins, your account converts to a paid subscription and becomes subject to these Terms
5. Subscription, Billing & Cancellation
a. Monthly Subscriptions
- Users may cancel their subscription at any time
- Cancellation stops future charges
- No refunds are provided for any partial, unused, or active billing month
b. Annual (Paid-in-Full) Subscriptions
If a user chooses to pay for 12 months in full upfront:
- The subscription may be canceled at any time
- A pro-rated refund may be issued for unused months only
- The refunded amount is calculated based on the number of unused months remaining
- Refunds apply only to the platform subscription fee
- Refunds are processed at AutomatikPro’s discretion and subject to payment processor timelines.
6. No Refunds on Monthly Payments
Except for the paid-in-full annual scenario described above:
All monthly subscription payments are non-refundable
This includes subscription fees, upgrades, and any completed billing cycles
7. Usage-Based Services, Add-Ons & Third-Party Fees
AutomatikPro™ does NOT charge for usage-based services or third-party add-ons provided through the platform, including but not limited to:
-VoIP / phone calls
-SMS or MMS messaging
-Email delivery
-AI usage
-Third-party integrations or add-on services
AutomatikPro™ charges only:
-Monthly platform subscription fees, or
-Annual (paid-in-full) platform subscription fees
8. Third-Party Billing & Account Balances
Usage-based services operate on a separate billing system and are charged based on actual usage.
-Usage charges are billed via an account balance or wallet
-Users may set their own auto-recharge limit or billing threshold
-Charges may occur monthly or whenever the balance threshold is reached
-These charges apply even if the user is on an annual subscription
AutomatikPro™ does not:
- Advance charge
- Pre-collect
- Bundle
- Estimate or include usage-based service fees within any subscription plan
This is because such charges depend entirely on real-time usage and third-party service providers.
9. Refund Clarification for Annual Subscriptions
If an annual subscription refund is issued:
- Refunds apply only to the platform service fee
- Usage-based services, add-ons, VoIP, SMS, AI, and third-party charges are non-refundable
- Refunds are calculated strictly on unused months of the platform subscription
- AutomatikPro™ does not hold or collect usage-based fees in advance; therefore, such fees cannot be refunded.
10. Acceptable Use
You agree not to use AutomatikPro™ for:
- Illegal or fraudulent activities
- Spam, unsolicited messaging, or deceptive marketing
- Violations of TCPA, CAN-SPAM, GDPR, or similar regulations
- Abuse of platform resources
- Uploading malicious code or attempting unauthorized access
AutomatikPro™ reserves the right to suspend or terminate accounts that violate these rules.
11. Intellectual Property
All software, designs, trademarks, branding, content, and platform technology are owned by AutomatikPro™ or its licensors.
Users receive a limited, non-exclusive, non-transferable license to use the Service while their account remains active and in good standing.
12. Data & Privacy
Users retain ownership of their data.
AutomatikPro™ acts solely as a service provider and does not sell or claim ownership over user business data. Use of the Service is also governed by our Privacy Policy.
13. Service Availability & Modifications
AutomatikPro™ may:
- Update or modify features
- Add or remove tools
- Perform maintenance or upgrades
Service availability is not guaranteed to be uninterrupted.
14. Disclaimer of Warranties
The Service is provided “as is” and “as available.”
AutomatikPro™ makes no guarantees regarding:
- Revenue or profits
- Lead conversion rates
- Marketing performance
- Business growth outcomes
15. Limitation of Liability
To the maximum extent permitted by law, AutomatikPro™ shall not be liable for indirect, incidental, or consequential damages, including loss of data, revenue, or business opportunities.
16. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Florida, United States.
Any disputes shall be resolved exclusively in courts located in Florida, USA.
17. Termination
AutomatikPro™ may suspend or terminate accounts for:
- Violations of these Terms
- Abuse of the platform
- Legal or compliance requirements
18. Changes to Terms
AutomatikPro™ reserves the right to modify these Terms at any time. Continued use of the Service constitutes acceptance of updated Terms.
